The Michigan Department of Agriculture and Rural Development (MDARD) is the responsible agency for conducting all food safety work in Michigan.  By delegatory authority, MDARD grants the 45 Local Health Departments (LHD) and the City of Detroit the ability to enforce the act and rules for foodservice establishments.  The LHD’s confirm that an establishment meets the requirements and forwards the recommendation to MDARD and a license is issued from MDARD to that establishment. MDARD directly oversees grocery stores, convenience stores, and markets throughout the state.

Montana Department of Public Health and Human Services provides licensing services for all retail food facilities in the state with the exception of temporary food facilities, which are permitted by the local agencies. While the state oversees licensing, all pre-license and periodic inspections of licensed retail facilities are conducted by the local agencies. Montana has 56 counties, however several counties have formed health districts which provide services to several counties under one umbrella. There are approximately 8,000 retail food facilities and 500 temporary food facilities within the state.
