Statewide code pre-empts local agencies from enacting their own provisions except in limited circumstances such as an inspection scoring or grading program. Local agencies are the primary permitting and inspecting agencies for retail food facilities. The state does not conduct routine inspections unless support is requested from the local agency or the local agency is unable or unwilling to conduct the inspection.
