The Alabama Department of Public Health (ADPH) is responsible for promulgating all statewide retail food safety regulations, providing standardized training to local agency personnel, and providing technical assistance. ADPH operates six health districts, in cooperation with county health departments, that conduct retail food safety work throughout much of the state. Jefferson and Mobile counties operate their own programs and are responsible for permitting and inspecting retail food establishments within their jurisdictions.

The California Department of Public Health has overarching authority over retail food safety and is responsible for promulgating all statewide retail food safety regulations. Statewide code pre-empts local agencies from enacting their own provisions except in limited circumstances such as an inspection scoring or grading program. Local agencies are the primary permitting and inspecting agencies for retail food facilities. The state does not conduct routine inspections unless support is requested from the local agency or the local agency is unable or unwilling to conduct the inspection. State is solely responsible for approving ROP HACCP Plans and variances for all retail food facilities.
