Modernization of Cosmetics Regulation Act of 2018 – Comment by 3-15-2018

March 2, 2018

The Senate Health Committee released a draft cosmetic regulation document for discussion. Interested parties are asked to submit comments by March 15, 2018.

This is an important opportunity to define the future of the regulatory environment for tattoo inks.

First, in this draft regulation, tattoo ink is not defined, therefore it is assumed it is still considered to be a cosmetic under this proposal.”Injected cosmetics” are explicitly identified as not eligible for exemption from certain aspects of the legislation.

Second, body art establishments/tattoo studios are left out of professional use exemptions for salons, barber shops, etc. (Sec. 609 Labeling).
