Abstract:

Guardrails or Gatekeepers? The Next Chapter of Hemp, Marijuana, and Federal Reform explores a question that is becoming impossible for regulators to avoid: What kind of cannabis market is the United States actually building? For years, hemp, marijuana, and pharmaceutical cannabis have been treated as separate legal worlds. In practice, however, they are all part of the same larger cannabis economy, shaped by the same plant, the same consumers, and many of the same public health concerns. As federal hemp policy tightens, state marijuana programs continue to evolve unevenly, and federal rescheduling opens new doors for some parts of the market while leaving others behind, regulators are no longer simply reacting to change. They are making design choices that will shape the future of cannabis access, commerce, and control.

This presentation looks at how we got here, why the current moment matters, and what is at stake if policy continues to develop in fragmented and inconsistent ways. It will examine upcoming changes to the hemp industry as it has existed in recent years, the rise of stricter state level interventions, the implications of federal rescheduling and DEA registration, and the unstable position of many state marijuana programs. But rather than treating these as separate stories, the presentation ties them together into a single regulatory question: Are we building a system of sensible guardrails focused on safety, transparency, and accountability, or a system of gatekeepers that narrows participation, limits product diversity, and concentrates power in the hands of a few large players?

Grounded in the Three Pillars of cannabis reform and a One Plant framework, this session offers a pragmatic path forward for regulators, lawmakers, and public health officials. It argues that the central policy challenge is not whether cannabis should be treated as good or bad, but how it should be governed in a way that protects minors, ensures product quality, and provides clear, enforceable labeling and packaging standards without losing sight of market reality. Designed for regulators and policy professionals, this presentation will challenge familiar assumptions, connect today’s legal turmoil to the longer history of cannabis regulation, and offer a timely framework for thinking about where federal and state cannabis policy is likely headed next.
