    • ·        THREAD: We've received multiple inquiries about which critical food operations continue during the shutdown. Examples of the work that we're still doing include: 1) High-risk domestic food surveillance inspections; 2) foodborne illness surveillance and outbreak investigations;
    • ·        3) Execution of high-risk food recalls; 4) Inspection of foreign food facilities; and 5) Sampling of imported food samples (including sampling for antibiotic residue contamination and decomposition analysis). These are among critical activities ongoing by dedicated, unpaid staff.
    • ·        SHUTDOWN UPDATE: We’ve been recalling inspectors to perform critical, high risk food safety inspections. We’ve been asked how many dedicated colleagues are currently working on these unpaid assignments. More people are on the way. Here’s a current snapshot of our field resources:
    • ·        So far we’ve called back about 100 investigators and 35 supervisors to conduct and support domestic food surveillance inspections of high risk products. These professionals are in addition to FDA staff who were already working high-risk inspections, like foreign food assignments.
    • ·        In addition, at #FDA’s Office of Import and Enforcement Operations, which cover International Mail Facilities and ports of entry, we have about 450 FDA staff in the field - including investigators, compliance experts and supervisors - supporting these critical safety operations
    • ·        More staff could be on the way depending on needs. This is a snapshot of some of our current inspection work on high-risk assignments. Taken together, it's smaller than our usual footprint. But we’re targeting the riskiest products to make sure that Americans remain protected.

    • ·        THREAD - SHUTDOWN UPDATE: The lapse in funding represents one of the most significant operational challenges in FDA’s recent history. But as an agency, we’re committed to fulfilling our consumer protection mandate, to the best of our abilities, under our current configuration.
    • ·        We analyzed activities with close input from senior career leaders & public health experts. Our plans always included activities to address immediate threats to human life & safety. But as lapse continues we’re evaluating additional activities we need to except to prevent threats
    • ·        FDA determined after careful analysis and in close consultation with senior career leaders and public health experts that the following activities should be considered excepted, unpaid work because they’re necessary to identify and respond to threats to safety of human life:
    • ·        The additional activities may be considered excepted work during a shutdown. Given the prolonged shutdown and compounding risk as time accrues; FDA is working to operationalize additional activities that exceed what we’ve done in past shutdown situations. Activities include:
    • ·        Expanded inspection activities beyond “for-cause” inspections to also include foreign and domestic food, drug, medical, device and pharmacy compounding surveillance inspections focused on the highest risk products and facilities;
    • ·        Expanded monitoring and analysis by the Coordinated Outbreak and Response Evaluation (CORE) Network to include additional food safety and foodborne illness outbreak surveillance, detection, and response activities;
    • ·        Surveillance sampling of imported high-risk foods, drugs, and devices, and the logistical coordination and laboratory support for allowable inspections and evaluation;
    • ·        Expanded monitoring and evaluating medical device adverse event and malfunction reports to include additional types of medical devices;
    • ·        Expanded activities related to surveillance and response for recalls (including Class I and Class II) as necessary to identify and respond to threats to the safety of human life;
    • ·        It is not business as usual at FDA. Many key functions aren't getting done. But we're focused on maintaining core activities that directly impact consumer safety and save lives. My priority is to our consumer protection mission and the people executing mission critical functions
    • ·        In the coming days, we’ll update on some additional activities that the #FDA plans to continue undertaking, especially activities related to veterinary health issues that have a direct impact on human life and safety.

    • ·        .@US_FDA continues to take actions to prevent future foodborne outbreaks through surveillance sampling. Here, an #FDA Consumer Safety Officer in Nogales, AZ, collects a sample of fresh produce (sweet peppers) to be analyzed by an FDA laboratory for microbiological contamination.
    • ·        THREAD: We appreciate US PIRG’s interest in the safety of the nation’s food system and we always welcome a larger conversation on the topic. Public health is our top priority and FDA is working hard to ensure the U.S. food supply remains among the safest in the world.
    • ·        While we agree with the premise that prevention is always better than a corrective action, such as executing a recall, there should be caution in using recall numbers alone as the sole metric for gauging long-term performance trends in food safety.
    • ·        Dramatic improvements in new tools to detect foodborne pathogens has likely resulted in an increased # of recalls. The complexity of supply chain for foods has also increased so one contaminated ingredient can trigger many recalls, which can affect the overall number of recalls.
    • ·        FDA ensures that recalls by companies – voluntary or involuntary – are initiated, overseen, and completed promptly and effectively, and that consumers have timely, actionable information to protect themselves and their families.
    • ·        Even during the lapse in funding, we're continuing to support recalls as necessary to identify and respond to threats to the safety of human life, and activities for the surveillance and inspection of high-risk foods.
    • ·        Over the past year, #FDA has made several key policy changes to improve and modernize its food recall processes -- with a focus on providing more meaningful information to consumers.
    • ·        More actions to improve our recall policies are planned, including ways to further improve our ability to track and trace products through the supply chain. We’ll continue to communicate on these efforts in the coming year.

    • ·        THREAD: Update on Shutdown - We have many dedicated staff conducting critical inspections of food and drug facilities who are in an “unpaid, excepted status,” meaning they're working on critical public health functions, without pay or reimbursement. This hasn’t gone unnoticed.
    • ·        We’ll support them in any way we can in their execution of these vital public health functions. Toward these goals we’re adopting new procedures that'll reduce the likelihood that they accrue balances on their government travel credit cards for cost of airfare and hotel/lodging.
    • ·        I admire very much the dedication of #FDA colleagues during these challenging times. This is especially true for field force who perform front-line inspection functions, and incur costs on personal credit cards related to travel. Our new steps are aimed at mitigating those costs.

    The Association of Food and Drug Officials (AFDO) received a scientific conference grant from the U.S. Food and Drug Administration.  The purpose of the award is to provide scholarships to state and local food & drug regulatory personnel to attend the 2019 AFDO Annual Educational Conference (AEC).  This year's AEC is being held June 22-26, 2019 at the Grant Hyatt Atlanta in Buckhead, Atlanta, GA.

    We will be able to fund a limited number of representatives to the conference.

    How to Apply

    To submit a scholarship application, click here: Application

    Deadline

    All applications must be submitted no later than the close of business on Friday, March 1, 2019.

    The Scholarship Review Committee will consider each application.  In some cases, we will only be able to assist with partial funding, but we will attempt to pay for a minimum of fifty percent of the cost of conference attendance to those selected recipients.  Applicants should not make travel arrangements until they have received confirmation of selection.  Selected recipients will be notified by Friday, March 29, 2019.

    Criteria for receiving funding will be based upon a number of factors such as: whether or not your agency has funded participation in the past; the number of participants previously and currently funded by your agency; how active you have been in AFDO; and any other sources of funding available to you, including agency reimbursement and/or regional affiliate assistance.  Preference will also be given to states which have active food, drug, and medical device regulatory programs and who have not been able to fund a representative due to the lack of out-of-state travel funds.

    Special Note:  Grant funds are extremely limited and cannot be utilized for Food or Registration Fees.  Please apply for funding only if you have no other option for attending the conference. 

    The theme for this year's conference is "Industry and Regulators Partnering for a Safer Supply of Food and Medical Products".

    FDA Issues Uniform Compliance Date, Technical Amendments on Nutrition and Supplement Facts Labeling Rules

    The U.S. Food and Drug Administration (FDA) announced today that January 1, 2022, will be the uniform compliance date for final food labeling regulations that are issued in calendar years 2019 and 2020. All food products subject to the January 1, 2022, uniform compliance date must comply with the appropriate labeling regulations when initially introduced into interstate commerce on or after January 1, 2022. This action does not change existing requirements for compliance dates contained in final rules published before January 1, 2019.

    The FDA issues regulations that sometimes require changes in the labeling of food. Since 1996, the agency has periodically announced uniform compliance dates for new food labeling requirements to minimize the economic impact on the food industry of having to respond separately to each change.

    Occasionally, the FDA will set specific compliance dates that are earlier or later than the uniform compliance date when appropriate. For example, when the FDA published two final rules regarding revisions to the Nutrition Facts and Supplements Facts Labels in May 2016, manufacturers were given more time to comply with the rules than the date prescribed by the uniform compliance date for food labeling regulations issued in calendar years 2015 and 2016. Then in May 2018, FDA extended the compliance dates for the rules from July 26, 2018, to January 1, 2020, for manufacturers with $10 million or more in annual food sales, and to January 1, 2021, for manufacturers with less than $10 million in annual food sales.

    FDA also today issued a final rule that provides technical amendments to the two regulations concerning Nutrition Facts and Supplement Facts labeling that were published May 27, 2016. Among the revisions made, the amendments correct errors made in some sample label illustrations, restore several inadvertent deletions, correct citations to three cross-references, and remove a sentence regarding the font size and bolding requirement for the “Calories” declaration in dietary supplement labels.

    For example, the technical amendments correct information about dietary fat in section 101.9(c)(2). This section, as published in the final rule on May 27, 2016, addressed total fat, but information about saturated fat, trans fat, polyunsaturated fat, and monounsaturated fat was inadvertently deleted. Another deletion that was corrected pertains to the use of an address or telephone number where consumers can obtain nutrition information for certain products in small packages, as described in section 101.9(j)(13)(i)(A).

    The rule also includes other minor revisions. For example, some sample Nutrition Facts labels included a line directly beneath “Saturated Fat” that did not extend completely to the left edge of the label, and one sample label omitted information regarding the number of servings per container as well as the serving size. A sample Supplement Facts label listed “sucrose,” rather than “sugar,” in the ingredients list. These and other errors, including a spelling error, are being corrected through the technical amendments.

    The final rule on technical amendments does not change the compliance dates for the final rules on the Nutrition Facts and Supplement Facts labels.

    • ·        ROMAINE INVESTIGATION UPDATE: #FDA and @CDCgov have identified one source for the E. coli romaine outbreak as the reservoir used by Adams Bros. Farms in CA. However, romaine lettuce from other farms could be affected. We will continue to investigate: https://go.usa.gov/xEqJX The farm identified is cooperating and hasn’t shipped any romaine since 11/20. They will recall all products that may have been affected and we are working with them on corrective actions before their next growing season. To date, 59 people have become sick in 15 states.
    • ·        REVISED CONSUMER ADVICE: With new info, #FDA can revise our recommendations on romaine lettuce. No need to avoid lettuce from San Luis Obispo, Santa Cruz & Ventura Counties harvested after 11/23. If you can’t confirm your romaine is from an unaffected source, discard immediately
    • ·        Working quickly with #CDC and state partners allowed us to efficiently find one source of the outbreak. Romaine lettuce will now be labeled on store shelves with the date and harvest origin, making it easier for us to give targeted info regarding future outbreaks.
